    The City should cease negotiations with this developer as this project is out of line with the Santa Clara Station Focus area, and VTA’s transit oriented development guidelines. The project also does not take any community feedback into account. The lease negotiation conducted today is not in line with the requirements of the surplus land act, and opens up the City to future litigation if it continues. I have sent a more detailed letter via email to the council.

    This project is located on the site of the city's most productive well. The city and residents can not afford to damage/destroy this well for a project. This project also did not follow the "surplus land act" and should be sent out to the community for a "visioning" prior to receiving a proposal from a developer. This project does not meet the station area plan and/or good transit center requirements. The community voiced severe concerns at the VTA held community meeting.

    I'm opposed to this negotiation because the developer has not demonstrated they will be utilizing this piece of city owned property to its full potential as transit oriented affordable housing. The city has not demonstrated thoughtful planning to maximize utilization of this high value transit oriented property via surplus land act. There is not enough transparency in CEQA mitigating measures around the the water well for district 5. We do not have district 5 representative to negotiate.
